In conjunction with the part 3 of our editorial installment “BUYER’S REQUIREMENTS IN THE EU” for the “Best Wine Importers” website, this addendum details the current legislation within the framework of the CMO for wine in the European Union with a compiled list of the relevant EU regulations for the imposed oenological practices, implementation regulations and general EU regulations on wine. Stemming from the aggregated effect of the buyer’s requirements on the wine distribution market, these factors became legislatively regulated in the following legal provisions:
Basic regulation:
Council Regulation (EC) No 491/2009 of 25 May 2009 amending Regulation (EC) No 1234/2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation). Publication OJ L 154 of 17.06.2009
Council Regulation (EC) No 479/2008 of 29 April 2008 on the common organization of the market in wine, amending Regulations (EC) No 1493/1999, (EC) No 1782/2003, (EC) No 1290/2005, (EC) No 3/2008 and repealing Regulations (EEC) No 2392/86 and (EC) No 1493/1999. Oenological practices:
Commission Regulation (EEC) No 2676/90 of 17 September 1990 determining Community methods for the analysis of wines. Publication OJ L272 of 03.10.1990. Regulation as last amended by Commission Regulation (EC) no 761/1999 of 12.04.1999.
Commission Regulation (CE) No 1622/2000 of 24 July 2000 laying down certain detailed rules for implementing Regulation EC (1493/1999) on the common organization of the market in wine and establishing a Community code of oenological practices and processes. First publication OJ L194 of 31.07.2000. Regulation as last amended by Commission Regulation (EC) no 2066/2001 of 22.10.2001.
Commission Regulation (EC) No 606/2009 of 10 July 2009 laying down certain detailed rules for implementing Council Regulation (EC) No 479/2008 as regards the categories of grapevine products, oenological practices and the applicable restrictions.
Commission Regulation (EC) No 436/2009 of 26 May 2009 laying down detailed rules for the application of Council Regulation (EC) No 479/2008 as regards the vineyard register, compulsory declarations and the gathering of information to monitor the wine market, the documents accompanying consignments of wine products and the wine sector registers to be kept.
Commission Regulation (EC) No 1607/2000 of 24 July 2000 laying down detailed rules for implementing in particular the Title relating to quality wine produced in specified regions . Publication OJ L185 of 25.07.2000.
General, transitional and final provisions:
Commission Regulation (CE) No 2729/2000 of 14 December 2000 laying down detailed implementing rules on controls in the wine sector. Publication OJ L316 of 15.12.2000.
Commission Regulation (EC) No 884/2001 of 24 April 2001 laying down detailed rules of application concerning the documents accompanying the carriage of wine products and the records to be kept in the wine sector. Publication OJ L128 of 10.5.2001.
